The Chairs reserve the right to impose time limits on oral
testimony.

SB 3038    RELATING TO EDUCATION                         EDU, JDC
        Includes under the department of education's zero
        tolerance policy, selling, consuming, and using a
        dangerous weapon, switchblade knife, intoxicating
        liquor, or illicit drugs during school hours, on
        school premises, during department-supervised
        activities, or on off school property.

SB 2996    RELATING TO JUVENILES                         EDU, JDC
SD1        Allows limited accessibility to juvenile records to
        school officials and persons involved in the treatment
        and supervision of minors in the areas of child abuse
        and law enforcement.  Requires notification from a
        court to appropriate school officials when a minor has
        committed any felony or misdemeanor involving curfew,
        gambling, alcohol, drugs, tobacco products, carrying
        of weapons, a sexual offense found in part V of
        chapter 707, HRS, assault or battery, larceny,
        vandalism, or graffiti.  (SD1)

SB 2042    RELATING TO SCHOOL RECORDS                    EDU, JDC
SD1        Adds a new section providing protection from suit to
        any school for disclosure of records regarding a
        student's dangerous conduct affecting others.  (SD1)

Testimony for the following three bills will be taken together:


 
SB 2063    RELATING TO CRIMINAL HISTORY RECORD CHECKS    HHS, JDC
SD1        Requires criminal history record checks for all
        applicants for licenses to operate adult residential
        homes, nursing homes, home health services, assisted
        living facilities, day care centers for elder disabled
        and aged persons, facilities providing care to
        dependent adults, and their employees who have access
        to the personal belongings of clients.  (SD1)


SB 2876    RELATING TO CRIMINAL BACKGROUND CHECKS FOR    HHS, JDC
SD1        THE DEPARTMENT OF HEALTH
        Authorizes the collection of criminal history record
        information for prospective employees, service
        providers, and subcontractors, who work in close
        proximity with clients when providing medical, mental
        health, or substance abuse services.  (SD1)

SB 2847    RELATING TO PROSPECTIVE ADOPTIVE PARENTS      HHS, JDC
SD1        Requires "prospective adoptive parents" to have
        criminal history records checks.  Authorizes and
        contracting for home studies. (SD1)

SB 2442    RELATING TO CAREGIVERS                        HHS, JDC
SD1        Allows caregiver of a child to give medical and
        educational consent by affidavit; provided that
        educational consent is limited to school-related
        medical care; subjects caregivers to criminal
        penalties for making false statement on an affidavit.
        (SD1)

SB 2930    RELATING TO CONTROLLED SUBSTANCES             HHS, JDC
SD1        Clarifies the director's subpoena powers.  Amends
        controlled substance list.  Clarifies the elements of
        the offense of visiting multiple physicians to
        unlawfully obtain controlled substances prescriptions.

SB 2931    RELATING TO CONTROLLED SUBSTANCES             HHS, JDC
        Conforms the State's Uniform Controlled Substance Act
        to federal drug laws.

SB 862     RELATING TO MEDICAL USE OF MARIJUANA          HHS, JDC
SD1        Allows for the acquisition, possession, cultivation,
        distribution, transportation, administration, and use
        of marijuana for medical purposes. (SD1)

24 hours prior to the hearing. Testimony may also be faxed if
less than 5 pages in length, to the Senate Judiciary Committee

to the Senate Sergeant-At-Arms Office at 1-800-586-6659, at least
24 hours prior to the hearing.  When faxing, please indicate to
whom the testimony is being submitted, the date and time of the
hearing, and the required number of copies needed for submittal.

If you require special assistance or auxiliary aids or services
to participate in the public hearing process (i.e., sign language
interpreter, wheelchair accessibility, or parking designated for
the disabled), please contact the committee clerk 24 hours prior
to the hearing so arrangements can be made.

Public Folder.  A folder labeled "Public Folder" containing the
measures and testimonies for the hearing will be available for
shared use by members of the public.
